On November 14, 2024, ACT | The App Association participated in the Do iOS Developers Conference in Amsterdam, an inspiring event dedicated to developers and businesses building in the iOS ecosystem. Our panel, moderated by Borbala Szucs-Bartfai, the App Association’s EU policy manager, explored how developers and small and medium-sized enterprises (SMEs) can navigate the EU’s complex regulatory landscape. Featuring insights from two App Association member company representatives, Donny Wals (DonnyWals.com) and Mitchel Volkering (vaic.at), the discussion shed light on the real-world effects of regulations like the General Data Protection Regulation (GDPR), the Digital Services Act (DSA), and the Digital Markets Act (DMA).

The role of regulation
Mitchel highlighted the vital role of GDPR in safeguarding sensitive data. However, he emphasised the significant compliance burdens it places on businesses, especially smaller ones. The practical challenges it introduces—such as navigating overlapping requirements and increased costs—pose significant hurdles for companies working to stay compliant.
Mitchel went on to discuss how well-intentioned regulations like the DSA and DMA often bring unintended consequences. These include added complexity, reporting requirements, and challenges related to privacy and security—burdens that can slow down progress and impact businesses of all sizes.
SMEs face unique challenges
Donny shared his experience as a small business owner navigating the ever-growing web of regulations. With limited resources, SMEs often face difficulties staying informed and compliant. He pointed out the need for clearer guidance and less duplication in regulatory requirements, noting: ‘Regulation can slow you down’.
Donny also raised concerns about the challenges posed by the ‘trader’ status under the DSA. This unclear designation can impose additional reporting burdens on SMEs operating in the app economy, further complicating compliance efforts. Several audience members echoed these challenges, underscoring the widespread need for more clarity and support for SMEs.
Building better dialogue between industry and policymakers
Both Donny and Mitchel emphasised that excessive regulation risks stifling innovation and creates barriers to growth. They agreed that a stronger dialogue between SMEs and policymakers is essential. Regulations need to reflect the realities of running a business in the tech space and focus on enabling innovation rather than creating unnecessary burdens.
The panel resonated with the audience, many of whom expressed a clear desire and need to engage with policymakers. This is a core focus of our work at the App Association: ensuring that SMEs can connect with policymakers to ensure their voices are heard and their challenges are addressed.
