I have to spend some time thinking about what this means and may post more about this later, but I would be remiss if I did not mention that the Federal Circuit issued a decision in Jacobsen v. Katzer today.
The appeals court overruled the lower court decision, which I discussed here, and held that use of the word "Condition" limits the scope of license, making copyright remedies such as injunctions (and statutory damages) available.
